Some towns have by-laws requiring that oil tanks greater than a certain age be replaced with double walled tanks prior to a home being sold. The cost and responsibility is upon the seller.
Harwich does not have a by-law requiring replacement of certain aged oil tanks, although we may adopt such a rule at a future town meeting. We do have a requirement that when a tank is replaced, the new tank must be “double walled”. Any failure of the inner liner provides a visual indicator of said failure.
A home inspector would likely point out an impending failure of an oil tank. A home buyer may request a tank replacement as part of the sale negotiation. Currently, the only requirement to change an oil tank is when it fails.
